These Terms of Service (“Terms”) govern your access to and use of our website located at jakenfinancegroup.com (the “Site”), including any content, functionality, and services offered on or through the Site. By accessing or using the Site, you agree to be bound by these Terms. If you do not agree with any part of these Terms, you must not access or use the Site.
1. Acceptance of Terms
By using the Site, you represent that you are at least 18 years old and have the legal capacity to enter into these Terms. If you are using the Site on behalf of an entity, you represent that you are authorized to bind that entity to these Terms.
We may update these Terms from time to time. Your continued use of the Site after any changes constitutes your acceptance of the updated Terms. It is your responsibility to review these Terms periodically.
2. Description of Services
The Site provides information about financial services, investment opportunities, and related content offered by Jaken Finance Group. The content on the Site is for informational purposes only and does not constitute financial, legal, or professional advice. We do not guarantee the accuracy, completeness, or timeliness of any information on the Site.

To access certain features of the Site, you may need to create an account. You agree to provide accurate, current, and complete information during registration and to update such information as necessary. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.
We reserve the right to suspend or terminate your account at any time for any reason, including violation of these Terms.

You agree not to use the Site for any unlawful or prohibited purpose, including but not limited to:

You may opt out of receiving marketing emails at any time by following the unsubscribe instructions included in each email or by contacting us directly. However, opting out will not affect transactional or service-related communications necessary for your use of the Site.

Our total liability to you shall not exceed the amount you paid to us, if any, in the twelve months preceding the claim.

12. Governing Law
These Terms shall be governed by the laws of the State of Illinois, without regard to its conflict of laws principles. Any disputes arising from these Terms shall be resolved exclusively in the courts located in Cook County, Illinois.
13. Changes to the Site
We reserve the right to modify, suspend, or discontinue any part of the Site at any time without notice.
14. Termination
We may terminate your access to the Site at any time for any reason. Upon termination, all provisions of these Terms that by their nature should survive (e.g., disclaimers, limitation of liability) shall continue in effect.

Closing times are in business days and commence upon receipt of appraisal payment and satisfaction of borrower conditions. Closing times may be delayed due to appraiser property access . All loans are subject to full underwriting for loan approvals. Jaken Finance Group only finances non-owner occupied investment properties.

How to read these terms if you are a borrower
Sections 1 through 15 above are the website terms. They are not a loan commitment, a rate lock, or a promise that any file will be approved. The sentences below explain those sections in plain language. They do not add duties, fees, or privacy promises beyond what the sections already say.
The terms bind the person who uses the site
Section 1 says you must be at least 18 and able to enter the terms. If you send a file for a limited liability company, you are saying you can bind that company. Jaken Finance Group may update the terms. If you keep using the site after a change, Section 1 treats that as acceptance. Check the date at the top from time to time. The date on this version is July 26, 2023.
Rates and articles are information, not advice
Section 2 says the site offers information about financial services and related content. It also says the content is for information only. It is not financial, legal, or professional advice. Section 2 says Jaken Finance Group does not guarantee that information on the site is accurate, complete, or current. A blog figure, a calculator result, or a sample payment is not your term sheet. Ask for terms on your own address before you rely on a number.
Accounts and who may send a file
Section 3 applies if you create an account. You agree to give information that is accurate, current, and complete, and to update it. You are responsible for keeping the password private and for activity under the account. Section 3 reserves the right to suspend or close an account for any reason, including a violation of these terms. Share a login only with someone you want to be responsible for.
What you may do with the writing and the tools
Section 4 says the text, graphics, logos, images, software, and other materials on the site are owned by Jaken Finance Group or its licensors. Copyright and trademark law protect them. You need prior written consent before you reproduce, distribute, modify, or make a derivative work from that material. Reading a guide and using the ideas in your own deal is ordinary use. Copying the guide onto another site is not.
If you submit comments or feedback, Section 4 gives Jaken Finance Group a non-exclusive, royalty-free license to use that submission to operate and improve the site. Do not upload a document you do not have rights to share.
Conduct that can get access cut off
Section 5 says you will not use the site for an unlawful or prohibited purpose. The examples already in that section are harmful, abusive, or obscene posts; interfering with the site’s function or security; trying to get unauthorized access; and using automated tools to scrape or extract data. Jaken Finance Group may remove user content that violates the terms. A loan scenario should be a real inquiry. It should not be a script that pulls the site.
Privacy and marketing email
Section 6 says the Privacy Policy is part of these terms by reference. That policy, not this explanation, is where collection and use of personal information are described. This page does not add a new privacy promise.
Section 7 says that if you type an email address into the site, you impliedly consent to marketing materials, newsletters, promotional offers, and other communications. The section says that consent comes from voluntarily submitting the address in connection with the services. You can opt out of marketing email by using the unsubscribe link in an email or by contacting Jaken Finance Group. Section 7 says opting out does not stop transactional or service messages needed to use the site. The section also says Jaken Finance Group complies with applicable email laws, and that providing the address is agreement to receive the materials until you opt out.
Other websites, warranties, and money claims
Section 8 says the site may link to other websites. Jaken Finance Group is not responsible for their content, privacy practices, or availability. You use those sites at your own risk. A link in a guide is a pointer. It is not an endorsement that creates a duty under these terms.
Section 9 says the site and its content are provided “as is” and “as available,” without warranties of merchantability, fitness for a particular purpose, or non-infringement. It also says Jaken Finance Group does not warrant that the site will be uninterrupted, error-free, or free of viruses. Any reliance on the content is at your own risk.
Section 10 limits liability to the fullest extent the law allows. It excludes indirect, incidental, special, consequential, and punitive damages, even if Jaken Finance Group was told the damages might happen. It caps total liability at the amount you paid Jaken Finance Group, if any, in the twelve months before the claim. If you paid nothing in that window, read that cap carefully before you assume a large recovery.
Section 11 is an indemnification clause. You agree to cover claims, losses, damages, liabilities, and expenses, including attorneys’ fees. It reaches your use of the site, a violation of the terms, or infringement of someone else’s rights.
Illinois law, changes, and how to ask a question
Section 12 says Illinois law governs the terms, without conflict-of-laws principles. Disputes are resolved exclusively in the courts in Cook County, Illinois. The office address below is in Hoffman Estates, which is in Cook County. That address is a mailing location. It does not move the venue section out of Cook County.
Section 13 says any part of the site may be modified, suspended, or discontinued at any time without notice. Section 14 says access may be ended at any time for any reason. Provisions that should survive, including the disclaimers and the limit on liability, stay in effect after access ends.
Section 15 says questions about these terms go to Jaken Finance Group at info@jakenfinancegroup.com. The lending desk number published on program pages is (833) 264-7776. That number is not created by Section 15. Legal questions about these terms still go to the email in Section 15.

Published loan ranges are not set by these terms
Nothing in Sections 1 through 15 sets a rate, a leverage cap, or a closing date. Program pages publish ranges, and the note under those pages says rates and terms are only for qualified borrowers and can change without notice. The same note says closing times are in business days and start when appraisal payment is received and borrower conditions are met, and that appraiser access can delay a closing.
As of the ranges published for borrowers, fix-and-flip and bridge loans run 8.99%–13.5%. They can close in 7–10 business days. Fix-and-flip leverage runs up to 100% of cost on qualified files and is capped at 75% of after-repair value. DSCR rental loans run 5.75%–10.5% and close in about 14 business days. DSCR loan-to-value runs up to 85% on purchase, 80% on cash-out, and 85% on rate-and-term, in select markets for qualified borrowers. Residential investment loans are for non-owner-occupied property. Lending is offered in all 50 states on qualified files.
Those sentences describe published programs. They do not amend Section 2, and they do not guarantee a rate or a closing date on your file. Approval still depends on full underwriting. If a page and a term sheet disagree, the term sheet for that file controls the loan. These website terms still control use of the site.
